Business Community Engaged in the Process to Establish a Specialized Labor Court
Cambodia continues to make progress toward the establishment of a new labor court. At a CEO’s luncheon organized by the Cambodian Federation of Employers and Business Associations (CAMFEBA), CAMFEBA President Van Sou Ieng announced CAMFEBA’s engagement of Sok Xing & Hwang to assist employers in the development of a policy position paper on the labor court and dispute resolution for presentation to the Ministry of Justice.
Ministry of Justice Secretary of State Chiv Songhak told attendees the Ministry continues to work on the legal, logistic and other groundwork necessary for the development and operations of a new labor court. The legal work includes amending existing laws, drafting new procedures and regulations tailored for labor cases, and coordinating with other higher level court systems. The Ministry is also preparing for the training of labor court judges, labor advisors and staff, determining court location, and preparing of budgets and identifying financial resources.
He stated the Ministry seeks to establish a court that operates efficiently, based on accepted legal principles and provides access to justice. He added the Ministry is considering to launch a pilot project for the smooth functioning of the new court of law dedicated to labor cases and welcomed input from the public, especially employers and workers.
During the panel discussion, Mr. Hans S. Hwang, Senior Director of Sok Xing & Hwang, reflected on the relationship between employers and employees as the basis of extraordinary economic growth in Cambodia and noted the important role a new labor court could play in preserving harmonious industrial relations.
